Bullying Mediation

Parents are taking a stand up position when it comes to reporting bullying issues at school. They are recognizing the signs of bullying and questioning their children so they are able to properly report issues to school authorities. However, there is a huge problem with schools not taking these reports seriously. If the bullying complaint falls under the definition of the state law and district code of conduct where the bullying is systematic and continuous which causes either physical or psychological hurt then schools are mandated to rectify the situation. This is not happening in many cases. Many parents think the only way to solve the problem is a lawsuit. Lawsuits that are typically filed are failure to supervise or failure to follow the anti bullying law. This would be under the Tort of Negligence. However there has to be injuries and damages and many cases do not arise to this level. There are solutions though: Hiring a lawyer to meet with school administration and legal counsel, along with the victim and family members, can be very helpful in mediating issues and solving problems within the school. Sometimes it just takes a face to face meeting where the victim and family can be heard. These meetings can consist of strategic problem solving in matters involving keeping the bullied victim safe and protected so the child can be in an environment conducive to learning.
